Artist Gets to Keep Her Green Card Despite Break-Up of Marriage

Rachel has always enjoyed teaching art classes to people of all ages and painting murals for local businesses. She almost lost this opportunity when she left her husband who had sponsored her for a green card (permanent residence).  Because Rachel's marriage was less than 2 years old at the time her green card was initially issued (approved), she was given a conditional green card, valid for only two years.  In most circumstances, to not lose the green card when the two years expires, the married couple must petition CIS together to release the condition so her permanent residence would be permanent (and not be cancelled).

Rachel was in a controlling relationship and she knew her husband would not be willing to file with her to take the condition off of her green card because that would give her some control. Her husband regularly subjected her to cruel threats of physical harm and psychological abuse.

She feared that no one would believe her because she never went to the police because she was afraid of him and lived in a small community. She was not with him long after she received her initial green card did not have many joint documents that others who were not in abusive relationships have access to that show they lived together and had a real marriage. She thought all hope was lost and she would soon lose her right to live in the U.S. after she left her husband.

Heather  took on Rachel's case and filed a waiver with CIS, taking Rachel's husband out of the process. This waiver asked CIS to remove the condition on her residence and make her a permanent resident without her husband's consent or knowledge, based on being a survivor of extreme cruelty from her spouse.  Not only was Rachel's case approved, it was approved without another CIS interview, saving Rachel the trauma of having to tell her story to a complete stranger.  This was a big win for Rachel, considering it had been CIS policy for years to send all waivers to interview, regardless of how strong the case was.  

Rachel has now been able to look forward to applying for US Citizenship which will allow her to bring her daughter from Colombia into the US even sooner. With an approved waiver, she is eligible to apply for citizenship in 3 years, not 5 years. Rachel writes about Heather and our firm:
